1. Introduction

These General Terms and Conditions (GTC) govern the use of the Udao platform by organizations and lay the foundation for successful collaboration. By registering and using our services, you agree to these terms and conditions and undertake to comply with all applicable data protection laws.

1.1 Scope of Application

These GTC apply to all organizations that use Udao to recruit talent and/or strengthen their employer brand. They include rules on the use of the platform, the handling of data, payment modalities, and the obligations of the organizations.

1.2 Obligation to Comply with Data Protection Provisions

By registering and using the Udao Platform, the Organization agrees to these GTC and undertakes to comply with them. It is the responsibility of the Organization to review these GTC regularly and stay informed of any changes.

2. Organization Profile

2.1 Registration Requirements

Organizations wishing to register on Udao are required to provide basic identification information. This includes:

  • Name of the Organization
  • Contact Information (including email address and telephone number)
  • Industry Sector
  • Organization Size

This information helps us to provide a customized experience on our platform and ensure that relevant services and features can be offered.

2.2 Authentication and Verification Process

A verification process is required to confirm the authenticity and legal existence of the organizations. Organizations must be able to provide official business documents (such as excerpts from the commercial register or business licenses). The verification process serves to create a trustworthy environment for all users of the platform.

3. Use of the Platform by Organizations

3.1 Purpose

Organizations can use Udao to:

  • Effectively recruit talent and expand their teams.
  • Strengthen their employer brand through targeted branding.

3.2 Terms and Conditions for Job Postings

Organizations wishing to publish job postings on Udao must register for an organization account and agree to the terms and conditions set forth, including payment terms and responsibilities regarding the content of the postings. Job postings must not contain inaccurate, misleading, or unlawful information and must comply with applicable labor laws.

3.3 Restrictions

To ensure the quality of the platform and guarantee an optimal experience for all users, the following restrictions apply:

  • Job Ads and Posts: The number of simultaneously active job ads or posts may be limited to prevent spam and improve visibility for all users.
  • Content Guidelines: Content must comply with Udao's guidelines and must not contain discriminatory, misleading, or unlawful information.

4. Interaction with Candidates

4.1 Communication and Interaction

  • Organizations may communicate and interact with candidates in the context of recruitment and networking. All interactions should be professional, respectful, and in accordance with Udao's policies.
  • When communicating directly with candidates via the platform, privacy and data protection regulations must be respected. Personal data of candidates must be treated confidentially.

4.2 Data Protection When Handling Candidate Data

  • Organizations must strictly adhere to data protection regulations and ensure that the processing of candidates' personal data is in compliance with the GDPR and other local data protection laws.
  • It is essential that organizations respect the privacy of candidates and manage personal data securely and responsibly.

5. Data Protection and Compliance

5.1 Compliance with Data Protection Laws

Organizations using Udao are required to strictly comply with all relevant data protection laws, including the GDPR and other local data protection regulations. This includes implementing appropriate measures to protect the privacy and security of candidates' data.

5.2 Responsible Handling of Data

It is essential that organizations handle candidates' personal data responsibly. This includes ensuring data security, restricting access to data to authorized personnel, and using data only for the stated purposes.

5.3 Compliance and Verification

Udao reserves the right to verify compliance with these data protection and compliance requirements. Organizations must cooperate with such reviews and may be asked to provide evidence of compliance with data protection practices.

6. Payment Modalities

6.1 Billing Models

Udao offers organizations flexible payment options to meet different needs and budgets. Billing can be done via different models:

  • Subscriptions: For organizations that want continuous access to recruitment services or course offerings, we offer subscription models with monthly or annual payment options.
  • Per Service: For organizations that want to use targeted services such as individual job advertisements or specific course offerings, there is the option of billing per service used.

6.2 Flexibility Through Pricing Models and Packages

Udao understands that every organization has unique needs. Therefore, we offer a range of pricing models and packages tailored to the specific requirements of organizations. Details of available options and pricing can be found on our website or contact our sales team for individual quotes.

6.3 Terms of Payment

Payment terms, including due dates and accepted payment methods, are clearly communicated when selecting a billing model or package. Organizations are asked to check the payment terms carefully and make their payments accordingly.

7. Content Requirements for Job Advertisements

7.1 Guidelines

  • Clearly Defined Standards: Job advertisements must be clear, precise, and truthful. They should contain detailed information about the position, required qualifications, and the application process.
  • Compliance with Labor and Anti-Discrimination Laws: Content must not contain discriminatory requirements based on gender, age, religion, ethnicity, or disability. Udao is committed to fostering an inclusive environment that promotes equal opportunity.

7.2 Review and Approval

  • Pre-review: Udao reserves the right to review job advertisements prior to publication to ensure compliance with these guidelines. Ads that do not meet the standards may be rejected or returned for revision.
  • Corrective Action: Organizations will receive support and guidance as needed to adjust their content to comply with the guidelines.

8. Representation and Warranties

8.1 Accuracy of Information

Organizations warrant that all information provided, including company and job vacancy data, is accurate and current. They undertake to update any changes promptly.

8.2 Compliance with the Law

By using the Udao Platform, organizations declare that they comply with all applicable local, national, and international laws and regulations, particularly with regard to employment law, data protection, and anti-discrimination.

Organizations must also comply with Udao's Platform Rules and Policies and agree not to use the Platform for any unlawful or improper activities.

8.3 Obligations

Organizations acknowledge that they are responsible for the content they publish on the platform and that they have the necessary rights, licenses, and permissions to use this content.

9. Rights and Obligations of Organizations

Organizations have the right to use the Udao platform in accordance with the defined GTC, including:

  • Publication of job advertisements.
  • Interacting with candidates and participants for recruitment purposes.
  • Use of analysis and reporting functions to evaluate the effectiveness of their advertisements.

The obligations of organizations include:

  • Providing accurate and up-to-date information in their organization profile and job advertisements.
  • Complying with all applicable laws and regulations relating to data protection, employment law, and non-discrimination.
  • Treating all platform users, including candidates and Udao employees, with respect.

Organizations must also ensure that their use of the platform does not lead to impairment of the services or damage to other users or the platform itself.

10. Termination and Withdrawal

Termination by Organizations

Organizations may terminate their membership with Udao at any time. Udao will handle all relevant data in accordance with data protection regulations and legal requirements.

10.1 Exclusion from the Platform

Udao reserves the right to exclude an organization from the platform in the event of serious violations of the GTC, data protection guidelines, or unlawful conduct. This includes misuse of the platform, fraud, discrimination, or violation of the rights of third parties.

Prior to exclusion, Udao will generally attempt to clarify the facts and give the organization the opportunity to comment on or correct its conduct.

10.2 After-effects of Termination

After termination of membership, all active job advertisements of the organization will be removed from the platform. Organizations must ensure that they back up all necessary data prior to termination.

11. Final Provision

Unless otherwise stipulated in these Terms of Use for Organizations, the General Terms of Use shall apply.
